TTP Rules

Using MYOBI’s Trust Network, Application(s) and participating in Information Ecosystems means that you’ll be in control of your Personal and Company data. This control gives you a grip on what happens to your data and who gets to see and use them.

MYOBI can organise this effectively and cost-efficient if all Users comply with MYOBI’s rules, including non-paying. MYOBI maintains these rules in the TTP policy. The moment you register with MYOBI as a User, you accept the TTP policy. In this document, you will find an overview of the key rules and an explanation of the composition of the TTP policy. You can only derive rights from the text of the TTP policy itself.

Considerations

A. An User wants control of what happens to his or her data and who gets to see and use them.

B. Using the own Information Ecosystem, the User organises the desired control over his or her data on the MYOBI Trust Network. The use of MYOBI’s Trust Network, Applications and participation in Information Ecosystems, is not without obligations. An User of the Trust Network must be able to trust that other Users, including non-paying, are compliant with legal and contractual obligations. These are written down in the TTP policy.

C. The TTP policy contains the rules for Users of the Trust Network and Trust Services. MYOBI explains the TTP method in a simple way on its website. Users and others can only derive rights from the text of the TTP policy itself.

1. Key rules

1.1. MYOBI explains on its website the working methods of the Trust Network. You has been able to take note of the method. Under the terms of the TTP policy, MYOBI licenses you to use the Trust Infrastructure, Trust Network, Trust services, Professional services and other Services. You enter into a three-year agreement with MYOBI.

1.2. On the Trust Network, MYOBI provides Trust services. The Trust services are concerned with authenticating the identity of Persons and Companies, providing them personalised electronic signatures, providing Companies with their Information Ecosystem and offering notary and brokerage services.

1.3. MYOBI manages the TTP policy and MYOBI Contract Portfolio. Based on the Personal and Company data Agreement and with the help of the contracts from the MYOBI Contract Portfolio, Users agree with their Partners on the use of Personal and Company data.

1.4. MYOBI’s Standardisation Board manages data definitions. The data definitions distract the Standardisation Board from relevant legislation and generally accepted standards. The Standardisation Board clusters data definitions in logical sets with the aim of facilitating data interoperability or data portability (exchanging data between partners) on the Trust Network.

1.5. A User can rely on other Users that they are compliant with the TTP policy, because they also accepted these rules of engagement and therefore the TTP policy. The TTP policy has the following compliance approach:

1.5.1. As part of the TTP policy, the Accountability Seal Policy concerns the guarantee of the reliability of the User’s Personal and Company data by the User himself, as well as the demonstration of the compliance with TTP policy’s obligations, in particular the TTP Code of Conduct GDPR, and with contractual agreements.

1.5.2. The TTP Code of Conduct GDPR is an authoritative data protection framework that provides Users with guidance on compliance with data protection obligations. The Association of Participants in Information ecosystems (VIE) administers the TTP Code of Conduct GDPR. Business Users of the Trust Network automatically become members of the Association.

1.5.3. Users express the extent to which they are compliant with the TTP policy, in particular the TTP Code of Conduct GDPR, in an Accountability Seal as part of a self-declaration. MYOBI facilitates Users to publish the Accountability Seal in an Accountability Seal register on MYOBI’s website.

1.5.4. The self-declaration on the degree of compliance with the TTP policy, in particular the TTP Code of Conduct GDPR, constitutes the object of investigation for the User’s Data Protection Officer to confirm the declaration; and

1.5.5. The self-declaration on the degree of compliance with the TTP policy, in particular the TTP Code of Conduct GDPR, also constitutes the object of investigation for MYOBI compliance staff to confirm the declaration.

1.6. Disputes may arise between Users of the Trust Network over compliance with legal and contractual obligations. MYOBI facilitates users with effective and cost-efficient dispute resolution based on Mediation.

1.7. For the use of the Trust Network, the User pays MYOBI annual upfront license fees. The license amount depends on the size of the User’s business activities. The use of the Trust Network is limited and free of charge to three accepted contracts.

1.8. MYOBI provides operational and financial logistics for Users of the Trust Network. The User can purchase Services using the Information Ecosystem, and MYOBI will charge the costs of the Services in the current-account between the User and MYOBI. The User settles (pays) the current-account with MYOBI. MYOBI plays the role of debtor manager.

1.9. MYOBI accredited Third Parties who can develop their Services on the Trust Network and offer it to Users. Users can use these Services on demand.

1.10. Periodically, MYOBI is accountable for society in general and Users of the Trust Network in particular, on the fulfilment of the obligations of the TTP policy. For this purpose, MYOBI uses the Service Level Agreement, Accountability Seal Policy and the TTP Code of Conduct GDPR.

2. Building up the TTP policy

2.1. The TTP policy consists of:

  1. TTP Agreement;
  2. TTP General Terms and Conditions;
  3. Personal and Business Data Agreement;
  4. Service Level Agreement;
  5. Accountability Seal Policy;
  6. TTP Code of Conduct GDPR; and
  7. Rules of Mediation.

2.2. In case of contradiction, the document as mentioned earlier will prevail over the later named document.

2.3. By agreeing to this document, you agree to the TTP policy.
